These Terms and Conditions (the “Terms and Conditions”) govern the use of the Eastport Civic Association website (www.eastportcivic.org, or the “Site”) and the participation in ECA events and activities.

This Site is owned and operated by Eastport Civic Association. This Site is the online portal of the Eastport Civic Association (ECA), a nonprofit membership-based community association.

User Conduct

Users agree not to engage in any activity that disrupts or interferes with the Site or its services, including unauthorized access to the Site. All communications through this Site shall be in a respectful and congenial manner.

Intellectual Property

All original content published and made available on our Site is the property of ECA. Some content may be provided by third parties and is presented on www.eastportcivic.org for member and community benefit and is for informational purposes only. Third-party content is the property of the content’s respective owners. Content includes, but is not limited to images, text, logos, documents, downloadable files, and anything that contributes to the composition of our Site.

Users may not copy, distribute, or otherwise use our content for commercial purposes without ECA’s explicit written permission.

Except where prohibited by law, by using this Site you indemnify and hold harmless ECA and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the State of Maryland.

Dispute Resolution

Subject to any exceptions specified in these Terms and Conditions, if you and ECA are unable to resolve any dispute through informal discussion, then you and ECA agree to submit the issue before a neutral arbitrator in written form within 30 days of the initiation of the dispute. The decision of the arbitrator will be binding and in writing. Any mediator must be a neutral party acceptable to both you and ECA.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time to maintain compliance with the law and to reflect changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

Purpose

GDPR

As a U.S.-based organization serving U.S. based members, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, known as the General Data Protection Regulation (the “GDPR”) is not applicable. Therefore we do not require users to acknowledge acceptance of our site’s use of functional cookies.

We have not appointed a Data Protection Officer because we do not fall within the categories of controllers and processors required to appoint a Data Protection Officer under Article 37 of the GDPR.

Although GDPR does not apply to our operations, we are committed to upholding the highest standards of data privacy and security.

Termination Clause

We reserve the right to terminate user access to the Site without notice for violation of these Terms or any other conduct deemed harmful to the Site or ECA.

Refund and Cancellation Policy

Membership fees and donations are generally nonrefundable. However, requests for refunds may be considered on a case-by-case basis.
